Ticket Coach

Terms of use

Draft, pending legal review

Effective the date you first use the service

1. Who we are

Ticket Coach is run by Tovelly Pty Ltd (ABN 11 685 168 334) ("we", "us"). These terms are an agreement between you and us about your use of this website and the Ticket Coach service. By creating an account or paying, you agree to them. Please also read our Privacy Policy.

2. What the service is

Ticket Coach is an online practice tool for candidates preparing for statutory mining exams: the Queensland Open Cut Examiner (OCE) certificate under the Coal Mining Safety and Health Act 1999 (Qld), and the Western Australian legislation exams for statutory positions under the Work Health and Safety Act 2020 (WA) and Work Health and Safety (Mines) Regulations 2022 (WA). It includes:

3. Practice only, and no affiliation

Ticket Coach is an independent study aid. It is not affiliated with, endorsed by or connected to Resources Safety & Health Queensland (RSHQ), the Board of Examiners, WorkSafe WA, the Department of Local Government, Industry Regulation and Safety (WA), the Mining Competence Advisory Committee or any government body. Our questions are not the real exam questions.

Our content is written from the legislation and checked by current certificate and statutory position holders. Laws, standards and exam practice change, however, and our content may sometimes be incomplete, wrong or out of date. Always check the current legislation and official RSHQ or WorkSafe WA material.

A good result in Ticket Coach does not mean you will pass the real exam. We do not promise any exam result.

4. AI marking and its limits

The examiner voice, the questions and the marking are generated by artificial intelligence, not by a human examiner. AI can:

Treat scores and feedback as a guide to help you study, not as a judgement of your competence. If you think a mark or a piece of content is wrong, tell us using the feedback button or at ben@tovelly.com.au and we will review it.

5. Eligibility

You must be 18 or over and able to enter a binding contract. The service is for your personal exam preparation. Access for teams or mine sites is offered under a separate licence.

6. Your account

7. Access period

Your purchase gives you access for 6 months from the date you pay, as shown at checkout. The date your access ends is shown in the app. If your exam date moves, email us and we will look at extending it. You can buy more time at the price current then; it is added on to any access you still have.

8. Price and payment

Prices are in Australian dollars and include GST where it applies. You pay up front through our payment provider, Stripe; we never see or store your card details. There is no automatic renewal unless you choose a plan that clearly says so.

Founding price: if you buy at the founding price ($290), that price applies for your whole purchased access period, even if our standard price rises.

9. Refunds and your consumer rights

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Change of mind. On top of your legal rights, if you are not happy you can ask for a full refund within 14 days of purchase, provided you have not completed more than one full mock oral. Email ben@tovelly.com.au. We refund to your original payment method.

Nothing in these terms limits your rights under the Australian Consumer Law.

10. Acceptable use

You must not:

11. Intellectual property

We, or our licensors, own the content, software, questions, marking guides and branding in Ticket Coach. We give you a personal, non-transferable licence to use them for your own exam preparation during your access period.

You keep ownership of your answers. You give us permission to store and process them to provide the service. We may also use them in de-identified form to improve our questions and marking. We will not publish your answers or show them to anyone else in a way that identifies you.

12. Availability

We aim to keep the service available and accurate but cannot promise it will be uninterrupted or error-free. We may need to pause it for maintenance, or because of problems with our providers (for example, hosting or AI services). If a significant outage stops you using the service for a meaningful part of your access period, contact us and we will extend your access or give a fair partial refund.

13. Our liability

Our liability under the consumer guarantees is not excluded. Beyond that, and to the extent the law allows:

None of this limits liability that cannot lawfully be limited, including for our negligence causing personal injury, or for fraud.

14. Suspension and ending your access

We may suspend or close your account if you seriously or repeatedly breach these terms (for example, by sharing your login or scraping content). We may also do so if we need to protect the security of the service or comply with the law. Where reasonable, we will warn you first and give you a chance to fix the problem. If we close your account for a reason that is not your fault, we will refund the unused part of your access period.

You can close your account at any time by emailing us.

15. Changes to the service or these terms

We improve the service over time, and we may update these terms. We will give at least 14 days' notice by email of any change that materially affects you. If a change significantly disadvantages you, you can end your access before it takes effect and we will refund the unused portion. We will not raise the price of access you have already paid for.

16. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the courts of Queensland and the Commonwealth. This does not take away any right you have to bring a claim where you live.
